These Terms and Conditions ("Terms") govern your use of SmartSalon, a software-as-a-service product provided by SmartSource Digital ("we", "us", "our"). By subscribing to SmartSalon, you agree to be bound by these Terms. Please read them carefully.

1. About SmartSalon

SmartSalon is a salon management platform that provides small hair and nail salons with tools including a client dashboard, automated review requests, a review collection form, an AI-powered caption and poster generator, and related features. SmartSalon is a product of SmartSource Digital, based in South Africa.

2. Subscription and Payment

SmartSalon is offered on a monthly subscription basis at R297 per month (VAT inclusive). Payment is processed securely via Paystack. By subscribing, you authorise us to charge your payment method on a recurring monthly basis.

• Your subscription renews automatically each month unless cancelled.
• If a payment fails, access to SmartSalon may be suspended until payment is received.
• Pricing may change with 30 days' written notice to your registered email address.

3. Cancellation

You may cancel your SmartSalon subscription at any time by contacting us via WhatsApp on 079 918 7860 or by email at support@smartsource.digital. Cancellation takes effect at the end of your current billing period. You will retain access to SmartSalon until that date.

Please refer to our Refund Policy for full details. In summary, we offer a 7-day satisfaction guarantee for new subscribers.

5. Your Responsibilities

By using SmartSalon, you agree to:

• Provide accurate information when setting up your account.
• Use SmartSalon only for lawful purposes and in accordance with these Terms.
• Not share your access credentials with third parties.
• Obtain appropriate consent from your clients before collecting their personal information through SmartSalon's forms.
• Comply with the Protection of Personal Information Act (POPIA) when handling client data.

6. Our Responsibilities

We will make reasonable efforts to ensure SmartSalon is available and functioning. However, we do not guarantee uninterrupted or error-free service. We reserve the right to perform maintenance, updates, or improvements that may temporarily affect availability.

7. Intellectual Property

All content, software, and materials forming part of SmartSalon remain the intellectual property of SmartSource Digital. You are granted a limited, non-exclusive, non-transferable licence to use SmartSalon for the duration of your active subscription.

8. Data and Privacy

We take your privacy and your clients' privacy seriously. Please read our Privacy Policy to understand how we collect, use, and protect personal information.

9. Limitation of Liability

To the maximum extent permitted by South African law, SmartSource Digital shall not be liable for any indirect, incidental, or consequential damages arising from your use of SmartSalon. Our total liability shall not exceed the amount you paid in the month in which the issue arose.

10. Termination

We reserve the right to suspend or terminate your access to SmartSalon if you breach these Terms, fail to make payment, or use the platform in a manner that is unlawful or harmful to others.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email at least 14 days before they take effect. Continued use of SmartSalon after that date constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the jurisdiction of the South African courts.
